Page No.# 3/3 2. Heard Mr. M. Ali, the learned counsel appearing for the petitioners as well as well as Mr. RR Kaushik, the learned Additional Public Prosecutor for the State of Assam. 3. Both these bail applications are filed under Sections 483 and 482 of the BNSS, 2023 praying of grant of regular bail as well as for grant of pre-arrest bail in respect of Lakhipur P.S. Case No. 278/2024. 4. The petitioner Dulal Sheikh has spent more than 60 days in judicial custody and it has been informed that no charge-sheet has been filed as yet. 5. I have considered the submissions made by the learned counsel of both sides. 6. For the aforesaid reasons, the petitioner is entitled to default bail. Therefore, his prayer for bail is allowed. 7. This Court is of the opinion that under the given circumstances of the case, the petitioner Dulal Sheikh, who was arrested in connection with Lakhipur P.S. Case No. 278/2024 shall be released on bail of ₹20,000/- with a surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Goalpara. Accordingly, the Bail Application No.396/2025 is disposed of. So far as the Anticipatory Bail Application No.336/2025 is concerned, call for the case diary. List it on 13.03.2025.
