Heard Mr. Rishabh Kumar Pandey, learned counsel for the petitioner. 2. The instant petition has been filed for the following relief: "issue an order commanding and directing the Civil Judge (S.D.), Banda to decide the Execution Case No.48 of 2024 (Kamlesh Kumar Vs. Salim) pending in the Court of Civil Judge (S.D.), Banda otherwise the applicant / petitioner shall suffer irreparable loss to decide the case within some stipulated period." 3. Learned counsel for the petitioner submitted that the Execution Case No.48 of 2024 in pursuance of the judgement and decree dated 21.8.2024 filed by the petitioner is pending before Court of Civil Judge (S.D.), Banda. He further submitted that the certified copy of order sheet of the case has been annexed as Annexure No.2 to the petition in order to demonstrate that the case is not proceeding expeditiously. 4. Without expressing any opinion on merits of the case and keeping in view of the facts and circumstances, Court of Civil Judge (S.D.), Banda is directed to decide the aforementioned Execution Case No.48 of 2024 (Kamlesh Kumar Vs. Salim) after giving an opportunity of hearing to the parties in accordance with law expeditiously preferably within a period of four months from the date of production of certified copy of this order before him. 5. Accordingly, the instant petition is finally disposed of.
