The petitioner has assailed an office order dated 17.10.2023 passed by the Deputy Conservator of Forests, Mandi Forest Division, Mandi, H.P. denying pension to the petitioner on the ground that his total length of regular service is 5 years, 2 months and 15 days as against the requisite service of 10 years. 1 Whether reporters of the local papers may be allowed to see the judgment? yes 2 3. Learned counsel for the petitioner submits that in case the decisions rendered in State of H.P. & Ors. Vs. Surajmani & Ors.2 and Satya Devi Vs. State of H.P. and others.3 are applied to the case of the petitioner, he would have to his credit the qualifying service required for the purpose of pension. Learned counsel, however, fairly submits that the decision rendered in Satya Devi3 has presently been stayed by the Hon’ble Apex Court. For this reason, learned counsel submits that the petitioner be permitted to withdraw the present petition at this stage with liberty to file afresh for assailing the order dated 17.10.2023 (Annexure P-8) and staking his claim upon pension at an appropriate stage, in accordance with law. 4. Prayer is not opposed. 5. Granting permission as prayed for, the present petition is disposed of as withdrawn. Pending miscellaneous application(s), if any, shall also stand disposed of.
