For Petitioner(s): M/s.C.Jeganathan For Respondent(s): M/s. Tippu Sulthan Government Advocate ORDER This writ petition has been filed to call for the records relating to the impugned order passed by the 4th respondent in his proceedings in REF.NO 2532/E1/1/19 dated 6.8.2019 and quash the same and consequently direct the respondents to consider the petitioner for promotion to the Post of Head of the Department of Neuro Surgery at Madurai Medical College without referring to disputed CML seniority for the year 2018. https://www.mhc.tn.gov.in/judis WP No. 23690 of 2019 2. When the matter is taken up the learned Government Advocate for the respondents submitted that proceedings have already been issued on 28.06.2023 by cancelling the impugned order of transfer and the petitioner continues to hold the very same post at Madurai. So far as CML seniority is concerned as per the direction given by this Court in W.P.No.24404 of 2018 and batch, dated 29.04.2022, a revised C.M.L. Seniority list of the year 2022 has been released. 3. In that case, the relief of promotion sought by the petitioner will be only in accordance with the revised CML Seniority List. If the petitioner has got any other grievance then his liberty would lie on challenging the revised CML list and not otherwise. 4. As the relief now sought has became infructuous in view of the issuance of revised seniority list, nothing survives for further consideration in this writ petition. 5. Accordingly the Writ Petition is closed as infructuous. No costs.
