IN THE HIGH COURT OF ORISSA AT CUTTACK W.P.(C). NO.12081 OF 2015 M/s. Bhagawati Electronics Process …. Petitioner None -versus- State of Odisha and others …. Opp. Parties Mr. Sabita Ranjan Pattnaik, Additional Government Advocate Mr. Pradipta Kumar Mohanty, Senior Advocate being assisted by Ms. K.T. Mudali, Advocate (For IDCO) CORAM: JUSTICE K.R. MOHAPATRA JUSTICE CHITTARANJAN DASH ORDER Order No. 27.10.2025 09. 1. This matter is taken up through hybrid mode. 2. Petitioner in this writ petition seeks to assail the order of cancellation of the lease dated 2nd June, 2015 granted in its favour by the IDCO. 3. This Court passed an interim order on 30th October, 2015 in Misc. Case No.11657 of 2015. 4. Mr. Mohanty, learned Senior Advocate appearing for IDCO submits that the land was allotted in favour of the Petitioner for industrial purpose on 20th January, 2001. Since the Petitioner has not commenced any activity on the said industrial plot. Thus, following due procedure of law and giving him an opportunity of hearing, the lease granted in favour of the Petitioner was cancelled, which is under challenge in this writ petition. Due to the interim order, the industrial plot could not be allotted to any other interested persons for industrial activity. In that view of the matter, he prays for dismissal of the writ petition and vacation of the interim order. Digitally Signed Signed by: ROJALIN NAYAK Designation: JUNIOR STENOGRAPHER Reason: Authentication Location: HIGH COURT OF ORISSA, CUTTACK Date: 28-Oct-2025 12:12:07 Signature Not Verified 5. Order sheet reveals that the interim order is not extended since 19th February, 2016. Today, none appears for the Petitioner on call. Since none appears on behalf of the Petitioner, this Court feels that the Petitioner has lost interest to pursue the matter. 6. Hence, the writ petition is dismissed for non-prosecution. 7. Interim order dated 30th October, 2015 passed in Misc. Case No.11657 of 2015 stands vacated. (K.R. Mohapatra) Judge (Chittaranjan Dash) Rojalin Judge Designation: JUNIOR STENOGRAPHER
