ORAL ORDER
In this petition, petitioner has sought for the following relief:-
“To allow this Memorandum of Criminal Petition by quashing the entire proceedings in S.C.496/2016 pending on the file of LXVI Additional City Civil & Sessions Judge, Bengaluru, initiated against this petitioner for offence punishable under Section 394 of IPC, in the interest of justice and equity”

Learned counsel for the petitioner – accused No.2 and
learned counsel for 2nd respondent – complainant have filed a Joint Compromise along with Joint Affidavit duly signed by the petitioner, 2nd respondent and their respective counsel and the same are taken on record. 3. Petitioner – accused No.2 and his counsel and 2nd respondent and his counsel are physically present before the Court and they admit the contents of the Joint Compromise and Joint Affidavit, which reads as under:-

“JOINT COMPROMISE PETITION It is respectfully submitted as follows:- That the petitioners herein is the accused No.2 in S.C No.496/2016 registered by Yeshvanthapura PS pending in the Court of LXVI Additional City Civil & Sessions Judge, Bangalore, initiated as against the petitioner based on the complaint filed by respondent No.2 for offences punishable under Section 394 of I.P.C. That the Petitioner in the above case and the complainant / Respondent No.2 have compromised and settled the dispute between them on the intervention of friends and well-wishers accordingly both the petitioner and Respondent No.2 are settled the case between them, hence the complainant / respondent No.2 do not wish to continue with the above case as against the petitioner in the above criminal petition as well as in S.C No.496/2016 registered by Yeshvanthapura PS pending on the file of LXVI Additional City Civil & Sessions Judge, Bangalore. Wherefore, it is humbly prayed that, this Hon'ble Court may be pleased to permit the above named petitioner and the respondent No.2 / Complainant to compound and compromise the above case in the interest or justice.”
“JOINT AFFIDAVIT We, a) Srinivas @ Seena @ Canter Seena S/o Govindappa, Aged about 32 years, R/at No.26, 6th Cross, Opposite to Albek Road, Gayathrinagara, Rajajinagara, Bengaluru 560 021 Permanently R/at No.30, Ramamandira Road, Chikkapete, Tumakuru - 572101. - 4 -

b) Santhosh S S/o Shivanna G. Hosahalli, Aged about 35 years, Gollarahatti, Bengaluru City – 560091 Permanently R/at Kotamaranahalli Village, Channapattana Taluk, Hassan District – 560 025, do hereby solemnly affirm and state on oath as follows:-
1. We submit that, we are the Petitioner and Respondent No.2, in the above case, we know the facts and circumstance of the case accordingly we are swearing this Joint affidavit. 2.
We submit that, based on the complaint filed by the Respondent No.2, a criminal case has been registered against the petitioner for an offence punishable under section 394 of IPC, now the said case in pending in S.C No.496/2016 registered by Yeshvanthapura P S pending on the file of LXVI Additional City Civil & Sessions Judge, Bangalore. 3. We submit that, on the intervention of friends and well wishers matter is settled between us, accordingly the complainant / respondent No.2 do not wish to continue with the above case as against the petitioner in the above criminal petition as well as in S.C No.496/2016 registered by Yeshvanthapura P S pending on the file of LXVI Additional City Civil & Sessions Judge, Bangalore. 4. In view of the settlement, we pray for quashing of the proceedings against the petitioner in S.C No.496/2016 registered by Yeshvanthapura P S pending on the file of LXVI Additional City Civil & Sessions Judge, Bangalore.”

4. In view of the aforesaid settlement entered into between the petitioner and 2nd respondent, I pass the following:
ORDER
(i) The petition is disposed of in terms of Joint Compromise and Joint Affidavit dated 21.07.2025.
(ii) The proceedings in S.C.No.496/2016 (arising out of Crime No.233/2011 of 1st respondent – Police) registered for the offence punishable under Section 394 of IPC pending on the file of LXVI Additional City Civil & Sessions Judge, Bengaluru, insofar as the petitioner is concerned are hereby quashed.
