Neutral Citation No. - 2025:AHC:114059 Court No. - 34 Case :- WRIT - C No. - 22284 of 2025 Petitioner :- Yaseen Respondent :- Collector, And 4 Others Counsel for Petitioner :- Udai Chandani,Waseem Akram Counsel for Respondent :- Arun Kumar Pandey,C.S.C. Hon'ble Rohit Ranjan Agarwal,J. The petitioner before this Court claims that notice in R.C. Form 20 was not served upon the petitioner and an ex-parte order for eviction was passed under Section 67 of U.P. Revenue Code, 2006. When the order was served upon petitioner on 20.06.2024, he had moved an application on 21.12.2024. The appeal filed against the ex-parte eviction order under Section 67(5) of U.P. Revenue Code, 206 has already been dismissed. I have heard respective counsel for the parties and perused the material on record. From perusal of the order impugned, it appears that the ex-parte proceedings were initiated against petitioner and an eviction order was passed under Section 67 of U.P. Revenue Code, 2006. No useful purpose would be served in keeping the matter pending or calling for counter affidavit. The writ petition stands partly allowed. The orders impugned are hereby set aside. The matter is remanded back to respondent no. 3. The petitioner shall file his objection/reply within 15 days from today along with certified copy of this order. Respondent no. 3, thereafter, shall proceed with matter and decide the same afresh under Section 67 of U.P. Revenue Code, 2006 after affording opportunity of hearing to petitioner and shall conclude the proceedings within next two months.
