The applicant is facing the trial for the offences punishable under Section 5 (j) (ii) / 6 of the POCSO Act read with section 376 (3) and 506 IPC arising out of case crime no. 0299 of 2024, Police Station – Vikas Nagar, District – Dehradun. 4. First bail application was dismissed as withdrawn on 06.05.2025, on the submission made by learned counsel for the applicant that applicant is ready to face the trial and in view this submission, the trial court was directed to proceed and conclude the trial in accordance with law. 5. Now, this second bail application has been moved on the ground that victim has been examined and she has not supported the case of the prosecution. 6. Be that as it may, on the previous date, first bail application was dismissed as withdrawn on the statement of learned counsel for the applicant that applicant is ready to face the trial, therefore, there is no purpose to grant the bail to the applicant. 7. Learned State Counsel apprise to this Court that trial proceeding is still going and in such an eventuality, trial court is directed to expedite the trial as early as possible preferably within six months from today. Accordingly, second bail application is rejected. 8. Registry is directed to send the copy of this order to the concerned trial court for necessary compliance. (Rakesh Thapliyal, J.) 08.07.2025. SKS
