The present contempt application has been filed pleading willful disobedience of the order dated 16.11.2022 passed by this Court in First Appeal From Order No. 2209 of 2022. It is the claim of the applicant that the opposite party has demolished the boundary wall existing over property of the opposite party. It is not the case of the applicant that the opposite party has encroached on the suit property or has committed any act changing the possession of the suit property. Mere demolition by a party of his own boundary wall neither changes the nature nor possession of any property. The averments made in the afÏdavit do not show any disobedience of the order passed by this Court so as to register proceedings under the Contempt of Courts Act, 1971.
