Heard Ms. M. Sahoo, learned counsel for the applicant.
2. This interlocutory application is preferred by the applicant for correction of the order dated 06.02.2025, passed in Bail Appln. No. 89/2025.
3. Ms. Sahoo, learned counsel for the applicant submits that while allowing
Page No.# 2/2 the bail application of the applicant by this Court, vide order dated 06.02.2025, in Bail Appln. No. 89/2025, in paragraph No. 8, this Court was pleased to observe that ‘on furnishing a bail bond of Rs. 50,000/- with one surety of like amount to the satisfaction of the learned Sessions Judge, Kamrup, Amingaon, the accused, namely, Rupen Rabha, shall be enlarged on bail’. But, instead of ‘the satisfaction of the learned Sessions Judge, Kamrup, Amingaon’, it ought to have been ‘the satisfaction of the learned Chief Judicial Magistrate, Kamrup, Amingaon’, and accordingly, Ms. Sahoo submits that necessary correction may be made so that the applicant can furnish the bail bond before the learned Chief Judicial Magistrate, Kamrup, Amingaon.
4. Having heard the submission of Ms. Sahoo, learned counsel for the applicant, I have carefully gone through the application and the documents placed on record and also perused the order dated 06.02.2025, in Bail Appln. No. 89/2025.
5. Taking note of the submission of Ms. Sahoo, learned counsel for the applicant and also taking note of the facts and circumstances on the record, this Court is inclined to allow this interlocutory application. It is provided that henceforth in paragraph No. 8 of the order dated 06.02.2025, in Bail Appln. No. 89/2025, in place of ‘learned Sessions Judge, Kamrup, Amingaon’, it shall be read as ‘learned Chief Judicial Magistrate, Kamrup, Amingaon’, for all purposes.
