Serial No. 02 SUPPLEMENTARY LIST IN THE HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT SRINAGAR Bail App 178/2025 CrlM(1269/2025) ALI MOHAMMAD DAR …Petitioner/Appellant(s) Through: Mr. Dawood Ahmad Bhat, Advocate Vs. UNION TERRITORY THROUGH POLICE STATION SHALTENG ...Respondent(s) Through: Mr. Ilyas Laway, GA vice Mr. Mohsin Qadri, Sr. AAG CORAM: HON’BLE MR. JUSTICE SANJAY PARIHAR, JUDGE ORDER 28.04.2026 1. After hearing learned counsel for the parties and upon consideration of the record, it is noted that the petitioner seeks grant of bail in anticipation of arrest. This Court, vide order dated 15.12.2025, had already extended interim protection to the petitioner, subject to furnishing of bail and personal bonds in the sum of ₹50,000/- each to the satisfaction of the SHO concerned. Nothing has been brought on record to indicate that, subsequent to the grant of such interim concession, the petitioner has either evaded the process of investigation or in any manner impeded the same. 2. It is further observed that the petitioner is alleged to have committed offences under Sections 318(4) and 338 of the BNS, which are not punishable with imprisonment exceeding seven years. In that backdrop, no compelling reason is made out for continuation of the present application. The petitioner, who is present in Court, submits that he has joined the investigation, though the said assertion is disputed by learned counsel for the respondent. 3. Be that as it may, the present application is disposed of by making the interim direction absolute, subject to the condition that the petitioner shall appear before the Investigating Officer, day after tomorrow at 10:00 A.M. and shall thereafter remain available to the Investigating Officer as and when required for the purposes of investigation. 4. The application stands disposed of accordingly. 5. Let a copy of this order be conveyed to the SHO of the concerned Police Station for compliance. All conditions imposed earlier shall remain intact and binding upon the petitioner. (SANJAY PARIHAR) JUDGE SRINAGAR: 28.04.2026 Akhil Dev
