ORAL ORDER This petition is filed by accused No.4 under Section 439 of Code of Criminal Procedure praying to grant bail in S.C.No.1421/2019 (Crime No.195/2014 of Mico Layout Police Station, registered for offences punishable under Sections 399 and 402 of Indian Penal Code, pending on the file of LXVI Additional City Civil and Sessions Judge, Bengaluru.

learned counsel for petitioner and learned High Court Government Pleader for respondent - State.

Learned counsel for petitioner would contend that, the petitioner earlier had been granted bail on 10.01.2022 and he has been released on bail. Thereafter,

the petitioner could not appear before the trial Court due to miscommunication between the petitioner and his counsel. The petitioner has been secured by executing a NBW issued against him on 29.09.2025 and from that day he is in judicial custody. The petitioner has now deposited Rs.50,000/- towards the forfeited bond amount on 03.12.2025 by way of Demand Draft in the trial Court. The petitioner undertakes to appear before the trial Court on all dates of hearing and cooperate for disposal of the case. Accused Nos.1 and 2 have been acquitted in S.C.No.1185/2014 by judgment dated 10.10.2019. With these, he prayed to allow the petition. 4. Per contra, learned High Court Government Pleader for respondent would contend that, due to the absence of this petitioner, the case registered against him could not to be proceeded with and caused delay in disposal of the case. With these, she prayed for dismissal of the petition. - 4 -

5. Having heard the learned counsels appearing for parties, the Court has perused the materials placed on record. 6. The petitioner has been arrayed as accused No.4 in Crime No.195/2014 of Mico Layout Police Station registered for offences under Section 399 and 402 of IPC. Earlier, the petitioner has been granted bail in Criminal Miscellaneous No.16/2022 by Order dated 10.01.2022 and thereafter, he has been released on bail. The petitioner earlier could not appear on 19.12.2022 and cash security furnished by him in a sum of Rs.10,000/- has been forfeited. Thereafter, the petitioner has been secured by executing NBW on 29.09.2025 and since that day, he is in judicial custody. The petitioners could not appear in the trial Court due to miscommunication between him and his counsel. The petitioner now has deposited Rs.50,000/- towards forfeited bond amount of Rs.1,00,000/-. The said deposited amount of Rs.50,000/- is to be appropriated to the State. The petitioner has undertaken to appear before

the trial Court and cooperate for speedy disposal of the case. 7. Considering all the above aspects, the petitioner has made out a case for grant of bail with conditions.
In the result, the following;
ORDER The Criminal Petition is allowed. The petitioner is granted bail in S.C.No.1421/2019 (Crime No.195/2014 of Mico Layout Police Station, pending on the file of LXVI Additional City Civil and Sessions Judge, Bengaluru, subject to following conditions: i) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with one surety for the like-sum to the satisfaction of the trial Court. ii) The petitioner shall not tamper the prosecution witnesses either directly or indirectly.

iii) The petitioner shall appear before the trial Court on all dates of hearing unless exempted by the Court and cooperate for speedy disposal of the case. The amount deposited by the petitioner in a sum of Rs.50,000/- shall be appropriated to the State towards forfeited bond amount.
The trial Court shall expedite the trial and dispose it of as early as possible, since the matter is of the year
2014.
