The present application u/s 528 of BNSS of 2023 has been filed with prayer to quash the order dated 23.05.2025 passed by Principal Judge, Family Court, Kaushambi in Maintenance Case No. 428 of 2021 (Manju vs. Chandra Prakash), arising out of an application under Section 128 of Cr.P.C., whereby an application to hear the matter through Video Conferencing has been rejected as provided in the Rules of Video Conferencing for courts and inspite of direction of a co-ordinate Bench of this Court in Transfer Application No. 246 of 2022. After some arguments, learned counsel for the applicant does not want to press the present application. In view of above, the present application u/s 528 of BNSS of 2023 is dismissed as not pressed with liberty to file appropriate application/proceedings before the court of competent jurisdiction. Certified copies of the relevant documents be returned to learned counsel for the applicant after retaining a photocopy of the same.
