This writ petition has been filed with the following prayer:- "a). Issue a writ, order or direction in the nature of mandamus commanding and directing the respondent no.2 Additional Commissioner First Azamgarh Region Azamgarh to decide the Restoration Application No.403/B (Shivanand Vs. Mahant and others) under order-9 Rule-13 readwith 151 of C.P.C. filed in case no.156 Under Section 331 of U.P.Z.A and L.R. Act (Mahant Vs. Bigu) Mauza-Chanduki, Pargana-Copachit Sharki, TEhsil-Sadar, District-Ballia, Pending before Additional Commissioner (Administration) Azamgarh Region, Azamgarh/respondent no.2." It is contended that restoration application is pending in proceedings under Section 331 of the U.P.Z.A. & L.R. Act which is registered as Restoration Application No.403/B, under Section 9 Rule 13 read with Section 151 of CPC. Learned counsel for the petitioner submits that the said restoration application may be decided expeditiously. As no useful purpose would be served in keeping the matter pending, or calling for counter affidavit, the matter is being disposed of, at the admission stage, with a direction upon respondent no.2-Additional Commissioner (Administration) Azamgarh Region, Azamgarh to decide the Restoration Application No.403/B, under Section 9 Rule 13 read with Section 151 of CPC filed in proceedings under Section 331 of U.P.Z.A. & L.R. Act, after hearing all the concerned parties, strictly in accordance with law expeditiously preferably within a period of one month from the date of production of certified copy of this order. With the aforesaid direction, present writ petition stands disposed of. It is made clear that this Court has not adjudicated the case on merit.
