The petitioner has preferred this bail application under Section 483 of BNSS in FIR No.5/2025 registered at Police Station- Jhanpadha, District-Dausa for the offences under Sections 331(4), 64(2)(m) and 351(3) of BNS, 2023. 2. Heard learned counsel for the petitioner as well as learned Public Prosecutor and perused the material available on record. 3. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. Counsel further submits that as per the version of the prosecution, petitioner was exploiting victim since 2020 and FIR has been registered around delay of five years. Counsel further submits that the victim is a 32 years old married lady. Counsel further submits that earlier in the [2025:RJ-JP:22020] (2 of 2) [CRLMB-2393/2025] year 2020, victim has lodged such type of FIR against the petitioner in which the victim herself has recorded compromise on 11.02.2022. He further submits that no obscene photo or video have been recovered from him. Petitioner is behind the bars since 02.02.2025. Charge-sheet has been filed in which offence under the IT Act has not been mentioned. The trial of the case may take considerable time. In support of his contention he has filed the copy of affidavit of victim dated 11.02.2022, hence the bail application of the petitioner may be allowed. 4. Learned Public Prosecutor has vehemently opposed the bail application. 5. On consideration of the rival submission and material available on record and deliberating all the facts and circumstances of the case, especially the compromise dated 11.02.2022 and FIR lodged after a delay of five years but without expressing any opinion on the merits/demerits of the case, I am inclined to grant benefit of bail to the petitioner. 6. Accordingly, the bail application under Section 483 B.N.S.S. is allowed and it is ordered that the petitioner-Hansraj S/o Laxminarayan shall be released on bail on his furnishing a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial court for his appearance before that Court on all the dates till conclusion of the trial.
