2. The petitioner has been made accused in connection with Pithoria P.S. Case No. 93 of 2023, for the offences registered under Sections 147, 148, 149, 341, 323, 324, 307 and 302 of the I.P.C., pending in the Court of Mrs. Kanchan Kumari, learned Judicial Magistrate, 1st Class, Ranchi.
3. On 12.06.2023, petitioner and co-accused persons assaulted the informant party, causing injuries to three persons. Later on, one of the injured Ashok Sahu succumbed to his injuries.
4. It was submitted that there is no allegation against the petitioner that he had assaulted the deceased Ashok Sahu. It was further submitted that the allegation against the petitioner is that he had assaulted Balram Sahu. It was finally submitted that co-accused Sujit Sahu and Jagan Sahu have been granted bail by a Co- ordinate Bench of this Court vide B.A. No. 7712 of 2024 and another co-accused Khurshid Ansari has been granted bail by this Court vide B.A. No. 10888 of 2024.
5. Mr. Jitendra Pandey, learned A.P.P. has opposed the prayer for bail, but does not dispute the aforesaid facts.
6. In view of the submissions made above, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of Mrs. Kanchan Kumari, learned Judicial Magistrate, 1st Class, Ranchi in connection with Pithoria P.S. Case No. 93 of 2023.
