The present bail application has been moved by the applicant-accused Mohd Tarik for the offence punishable under Section 2/3 U.P. Gangsters and Anti Social Activities (Prevention) Act, 1986, in Case Crime No. 303 of 2024, Police Station- Titavi, District-Muzaffarnagar. 2. Sri Anand Kumar Tiwari, learned advocate, holding the brief appeared for the applicant and submits that the accused applicant has been falsely implicated in the present case. The accused has been bailed out in all two cases detailed shown in the gang chart. It is further submitted that the accused applicant is having criminal history of three cases, which is shown in paragraph no. 10 to the affidavit filed in support of the bail application. It is further submitted that he is languishing in jail since September, 2024. As such, he prays that the accused/applicant be enlarged on bail. 3. Per contra, learned A.G.A. has opposed the bail application but could not dispute the aforesaid facts. 4. This court has taken into consideration the rival submissions made by learned counsel for the parties and perused the records. 5. The perusal of the record prima facie reveals that there are two cases in the gang chart shown as base cases, in which, the accused is on bail. In three cases of criminal history, the accused is on bail, which are duly explained in paragraph no. 10 to the affidavit filed in support of bail application. He is in jail since September, 2024. 6. Hence, without touching merit of the case, the bail application is allowed. 7. Let the applicant be released on bail in the aforesaid case crime on his executing a personal bond and furnishing two sureties each in the like amount to the satisfaction of the court concerned.
