Order No.02
Date: 27.03.2025
1. The present writ petition has been filed for issuance of direction upon the respondent no.7-the District Manager,
2 W.P.(C) No.1508 of 2025 Jharkhand State Food and Civil Supplies Corporation Limited to pass a reasoned order as to why the food grains to the extent of 440.62 quintals have not been supplied to the petitioners being PDS Dealers towards Store Issue Orders (S.I.O.) No.236600, 333792, 2069157, 342196, 1646978, 2004094, 348801 and 236599 for the period from 6th December, 2012 to 6th December, 2022 despite depositing Rs.23,533/-, Rs.6,479/-, Rs.1952 and Rs.7010 by them respectively (total Rs.48974/-) by way of demand draft.
2. Heard the learned counsel for the parties and perused the materials available on record.
3. Admittedly, the period for which the petitioners being PDS Shop Dealers were supposed to get food grains was from 6th December, 2012 to 6th December, 2022 and if at present the aforesaid quantity of food grains is supplied to them by the respondent-authorities, the same cannot be distributed to the concerned beneficiaries, who during the relevant period were attached to their PDS Shops. So far as distribution of food grains to the present beneficiaries attached to the petitioners’ PDS Shops is concerned, they get fixed amount of food grains as per the government scheme. It is not the case of the petitioners that at present, food grains for distribution to the present beneficiaries attached to their PDS Shops are not being supplied by the Jharkhand State Food and Civil Supplies Corporation Limited. Hence, if food grains to the extent of 440.62 quintals is now supplied to the petitioners, there is all
3 W.P.(C) No.1508 of 2025 possibility of its misuse by them. Under the said circumstance, I am not inclined to entertain the aforesaid prayer made in the present writ petition.
4. The writ petition is, accordingly, dismissed.
5. The petitioners are, however, at liberty to claim for refund of the amount deposited by them before the concerned authority which will be considered by the said authority appropriately.
