Heard Mr. K. Thakur, the learned counsel appearing for the petitioner as well as Mr. RR Kaushik, the learned Additional Public Prosecutor appearing for the State of Assam. 2. This is an application under Section 483 of the BNSS, 2023, whereby the petitioner Suruj Saharia has prayed for releasing him on bail, after he was arrested in connection with Bhangagarh P.S. Case No. 182/2024. Page No.# 2/2
3. A person called Bidyut Bikash Deka was an employee of SIS Cash Services Pvt. Ltd., which replenished different ATMs in the city of Guwahati. It is alleged in the FIR that Bidyut Bikash Deka did not replenish the ATMs properly and he embezzled a big amount of money. He used to deposit different amounts of money in the bank accounts of different persons. The present petitioner, who has account in the State Bank of India, Mangaldoi Brahch is one of them in whose account ₹11,000/- was deposited. 4. The petitioner states that he did not know the aforesaid fact and without his knowledge the money was deposited in his account. 5. The petitioner has already spent 63 days in custody. 6. I have considered the submissions made by the learned counsels of both sides. 7. This Court is of the opinion that the petitioner no longer deserves to be detained in custody. Therefore, his bail application is allowed. 8. It is hereby directed that the petitioner, Suruj Saharia, who was arrested in connection with Bhangagarh P.S. Case No. 182/2024, shall be released on bail of ₹25,000/- with a surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Kamrup (Metro), Guwahati, Assam. 9. It is further directed that State Bank of India, Mangaldoi Branch shall not allow withdrawal of ₹11, 000/- from the bank account of the present petitioner. The learned Additional Public Prosecutor shall take necessary steps to that effect.
With the aforesaid direction, the bail application stands disposed of. JUDGE Comparing Assistant
