THIS PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE B M SHYAM PRASAD - 3 - HC-KAR NC: 2025:KHC:31596 WP No. 24394 of 2025 ORAL ORDER The petitioner, who is 74 years old, is aggrieved by the notice dated 01.08.2025 issued by the first respondent [Annexure - A]. The first respondent has issued this notice stating that a complaint is received against the petitioner alleging that he is responsible for some quarrel and assault based on caste. Mr. C. N. Mahadeshwaran, the learned counsel for the petitioner, submits that this Court must intervene because the notice does not indicate the provision under which the petitioner is called upon to participate in the inquiry and the learned counsel also states that the petitioner has responded to the notice. Mrs. K. P. Yashodha, the learned Additional Government Advocate, who is called upon to accept notice for the first respondent, is heard for final disposal of the petition. - 4 - HC-KAR NC: 2025:KHC:31596 WP No. 24394 of 2025 This Court is of the view that if the first respondent has issued the notice and there is a response from the petitioner, the first respondent must consider the same but without insisting on his personal appearance given his age and the assertion that he is bedridden. While so observing and also stating that the petitioner must be at liberty to avail every remedy that is permissible in law if there is any apprehension of arrest, the petition stands disposed of.
