Petitioner has approached this Court with the grievance that constructions on his own land are being demolished by the State authorities without any justification. Learned Standing counsel has invited our attention to the report submitted on the grievance redressal forum according to which certain constructions were made on the roadside land which alone has been got demolished. Petitioner had no right over such land. Spot memo etc is also annexed alongwith such report. It is submitted that there is otherwise a dispute between petitioner and respondent nos.10 and 11 in respect of immovable property for which the remedy would lie elsewhere. In view of the specific stand of the respondents that only unauthorized encroachment has been removed we do not find any occasion to interfere in the present writ petition. Even otherwise for any private dispute in respect of immovable property remedy of the petitioner would to approach the competent civil court for necessary relief. A writ petition would not lie for such purposes, at the first instance. Leaving it open for the petitioner to pursue remedy before the competent civil court in respect of the grievance raised, this petition is consigned to records.
