PP CORAM: JUSTICE G. SATAPATHY Order No. ORDER(ORAL) 18.11.2025 01. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode). 2. This is a bail application U/S.483 of the BNSS by the petitioners for grant of bail in connection with Begunia Excise Station PR No. 152 of 2025-26 arising out of TR Case No. 108 of 2025 pending in the Court of learned 1st Addl. Sessions Judge-cum-Special Judge under NDPS Act, Dist-Khurda for commission of offences punishable U/Ss. 20(b)(ii)(B) of the NDPS Act, on the main allegation of possessing 3 Kgs of Contraband Ganja. 3. Heard, Mr. A.K. Barik, learned counsel for the petitioners and Mr. M.K. Mohanty, learned Additional Public Prosecutor in the matter and perused the record. 4. After having considered the rival submissions and taking into consideration the nature and gravity of the offence as alleged against the Petitioners vis-à-vis the accusation sought to be brought against them and regard being had to the pre-trial detention of the Petitioners in custody since 25.09.2025 and the quantity of Contraband articles seized in this case being intermediate in nature which does not attract the conditions of Section 37 of NDPS Act, this Court without expressing any view on merits admits the petitioners to bail. 5. Hence, the bail application of the petitioners stands allowed and they are allowed to go on bail on furnishing bail bonds of Rs.50,000/- (Rupees Fifty Thousand) each with one solvent surety for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it. 6. Accordingly, the BLAPL stands disposed of. Issue urgent certified copy of the order as per rules. (G. Satapathy) Judge Priyajit
