ORAL ORDER
1. The present successive bail application has been preferred by the applicant – original accused No. 1 under Section 438 of the Bhartiya Nagarik Suraksha Sanhita, 2023 (for short, “BNSS”) in connection with FIR No. 11191044250155 of 2025 registered at Ghatlodiya Police Station, Ahmedabad.
2. Learned advocate Mr. Meet A. Shah for the applicant submitted that the present applicant – accused is in jail for the o?ences punishable under Sections 316(5) and 318(4) of the Bhartiya Nyaya Sanhita, 2023. It is further submitted that the present applicant – accused was arrested on 16.07.2025 and is presently in jail.
3. On perusing the case on hand, as per the statements and allegations made in the complaint, the present applicant along with the co-accused is alleged to have lured customers and received used ornaments under the guise of promising handsome returns.
R/CR.MA/22900/2025 ORDER DATED: 14/11/2025 After obtaining the same, the applicant is alleged to have invested and thereby amassed a huge amount to the tune of Rs.2,30,71,960/- and thereafter failed and neglected to return the said ornaments received during the transactions under di?erent modes, and thus is alleged to have cheated or committed fraudulent acts upon the customers.
4. It further transpires that the co-accused – the maternal uncle of the present applicant has been released on anticipatory bail by the learned Sessions Judge vide Criminal Misc. Application No. 5588 of 2025. It also transpires that the investigation is over and the charge-sheet has been Dled. It is further submitted by the learned advocate for the applicant that the present applicant has no past antecedents.
5. Learned APP for the State has submitted that considering the
facts and circumstances of the case, appropriate order may be passed.
6. In view of the above, RULE. Learned APP waives service of Rule for the respondent – State. The applicant – accused is ordered to be released on bail, if he is not required in any other o?ence, on the following terms and conditions:- (i) The applicant – accused shall furnish personal bond in the sum of Rs.10,000/- with the surety of the like amount before the learned trial Court. (ii) Not to misuse the liberty granted to him by this Court and shall not involve himself in any other o?ence; (iii) The applicant – accused shall furnish the correct

7. Direct service is permitted.
