PUBLIC PROSECUTOR The Court made the following: COMMON ORDER: The instant petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita Act, 2023 has been filed by the Petitioners/A.1 to A.3, seeking quashment of the Proceedings against them in Crime No.8 of 2025 on the file of Veldurthy Police Station, Palnadu District registered for the offences punishable under Sections 115(2), 109(1), 351(2) read with 3(5) of BNSS Act, 2023. 2. I.A.No.2 of 2025 is filed by the Respondent No.2/ de facto Complainant under Section 320(6) of the Code of Criminal Procedure (for short ‘Cr.P.C.’), seeking permission to compromise the matter between the parties. 3. I.A.No.3 of 2025 is filed by Respondent No.2/De facto Complainant under Section 320(2) Cr.P.C., seeking to record the compromise and quash the 2 Proceedings in Crime No.8 of 2025 on the file of Veldurthy Police Station, Palnadu District against the Accused. 4. Petitioner No.1/A.1 is the elder sister’s son of Respondent No.2/de facto Complainant. Petitioners 2 and 3/A.2 and A.3 are friends and all are doing agriculture by using tractors in the agriculture fields in the same village. On 01.02.2025 some quarrel took place between the parties and all the accused attacked on respondent No.2 with axe and caused blood injuries on his body. On 04.02.2025 the Complainant gave a complaint against A.1 to A.3, which is registered as a case in Crime No.8 of 2025 of Veldurthy Police Station Palnadu District. Seeking quashment of the said Proceedings, Petitioners filed the present Criminal Petition. 5. During pendency of the case, the parties entered into compromise and filed IA Nos.2 and 3 of 2025 seeking permission to compromise the matter and to record the compromise and to quash the proceedings against the Accused. 6. Petitioners and respondent No.2 appeared before this Court and were identified by their respective learned counsel. Copies of their Aadhar cards attested by their respective counsel are filed for proper identification. 7. Ms.K.Priyanka Lakshmi, learned Assistant Public Prosecutor appearing for respondent No.1/State is in attendance. 8. As seen from the Joint Memo filed in IA No.3 of 2025, the parties entered into compromise. The contents of the Joint memo read as under: 3 JOINT MEMO FILED BY THE PETITIONERS AND THE PETITIONERS/ACCUSED No.1 to 3 It is submitted that the Petitioners/Accused No.1 to 3 and Respondent No.2/De facto Complainant has compromised the matter out of Court in F.I.R.No.8 of 2025 dated 04.02.2025 on the file of the P.S. Veldurthy, Palnadu District for the offences under Sections 115(2), 109(2), 351(2) read with 3(5) BNS and does not want to prosecute the matter any further and to this effect a separate compromise petition is also filed. Hence this joint memo. 9. Considering the submissions, in the interests of justice, I.A.Nos.2 and 3 of 2025 are allowed. Consequently, the Criminal Petition is allowed and the Proceedings against the Petitioners/A.1 to A.3 in F.I.R.No.8 of 2025 on the file of Veldurthy Police Station, Palnadu District are hereby quashed.
