Petitioner filed a suit for permanent injunction in the court of Civil Judge (S.D.), Haridwar, which was numbered as Original Suit No. 154 of 2017. The said suit, however, was dismissed for non- prosecution on 08.11.2021. 4. According to the petitioner, he has moved an application, under Order 9 Rule 9 of CPC, seeking restoration of the suit on 18.07.2022, which is numbered as Miscellaneous Case No. 29 of 2022, which is pending consideration before the court concerned. 5. By means of this writ petition, petitioner has sought a direction to expedite disposal of the said application. 6. Having regard to the facts and circumstances of the case, learned Civil Judge (S.D.), Haridwar is requested to consider and decide restoration application, filed by petitioner, which is numbered as Miscellaneous Case No. 29 of 2022 as early as possible, but not later than eight weeks from the date of production of certified copy of this order, provided reasonable time was given to defendant(s) to file objection to the restoration application.
