HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Civil Writ Petition No. 4892/2014 Abdul Khalid S/o Isahaaq Mohammed aged 48 years, R/o Kot, Mohallah, Kaithun Tehsil Ladpura, Kota. ----Petitioner Versus Fazlu Mohammed S/o Ali Mohammed, R/o Kot, Mohallah, Kaithun Tehsil Ladpura, Kota. ----Respondent For Petitioner(s) : Mr. Mohd. Haris, Adv. For Respondent(s) : Mr. Shailesh Prakash Sharma, Adv. HON'BLE MR. JUSTICE NARENDRA SINGH DHADDHA Order 10/01/2025 The instant petition has been filed by the petitioner- plaintiff(for short ‘the plaintiff’) against the order dated 16.12.2013 passed by the Additional District Judge No.4, Kota (for short ‘the appellate court’) in Civil Miscellaneous Appeal No.47/2013, whereby the appellate court while allowing the appeal filed filed by the defendant, set-aside the order dated order dated 07.10.2013 passed by the Additional Civil Judge (Junior Division) & Judicial Magistrate No.1 Kota (South) (for short ‘the trial court’), by which the T.I. application filed by the plaintiff was allowed. Taking into consideration the facts and circumstances of the present case and more particularly in view of the fact that the suit was filed before the trial court in the year 2013, thereafter 11 years have been passed, instead of interfering with the impugned (2 of 2) [CW-4892/2014] orders, I dispose of civil writ petition with a direction to the trial court to decide the suit, if pending with it, expeditiously, in accordance with Law. Registry is directed to send a copy of this order to the concerned trial court forthwith for information and compliance. Pending application(s), if any, also stand disposed of.
