The present Writ Petition has been filed by the petitioners, the developers of the housing project known as 'Deccan Habitat' situated at Pipeline road, Raghavendra Layout, Yeshwantpura, Ward No.38 (Old No.2), Bengaluru-560022.
2. The respondents are the flat buyers in the said project, have approached the National Consumer Disputes Redressal Commission (for brevity "the National Commission") at New Delhi in NC/CC/No.136/2024 seeking several reliefs in respect of the alleged deficiency in service in implementing the project, contrary to the promise made to them.
3. The petitioners herein have filed an applications i.e., I.A.Nos.16572/2024 and 16573/2024 during the said complaint filed by the respondents, raising the issue of maintainability of the complaint before the National Commission. The National Commission is seized of the matter including the said applications. Now the petitioners have

HC-KAR NC: 2025:KHC:42460-DB WP No. 12766 of 2025 approached this Court in the present Writ Petition impugning the very same proceedings pending before the National Commission in Consumer Complaint NC/CC/No.136/2024 alleging that the proceedings before the National Commission are not maintainable.
4. We have considered the submissions.
5. The National Commission is competent to decide its own jurisdiction and in fact, it is seized of the matter regarding of the maintainability of the complaint on two Interlocutory Applications filed by the petitioners herein.
6. We are of the considered view that this Court should not interfere in such Writ Petition and it is for the competent Forum/Court to decide first on its jurisdiction, if an objection is taken regarding the jurisdiction of Forum/Court. In view thereof, we dismiss this Writ Petition as not maintainable.
7. All contentions raised in this Writ Petition are left open for the parties to urge before the National Commission
8. Interim order granted in this petition stands vacated.
