Heard learned counsel for the petitioners, Sri Ved Prakash Pandey, learned counsel for the respondents no. 4 to 5, learned AGA for the State and perused the record. The present Habeas Corpus writ petition has been filed seeking direction in the nature of Habeas Corpus directing the respondent Nos. 2 and 3 to produce the corpus of petitioner no. 1/detenu before this Hon'ble Court and to set her at liberty. Before pressing the petition, learned counsel for the respondents states that the corpus is present before this Court. As per the High School Certificate, the date of birth of the corpus is recorded as 13.03.2004 and is accordingly major. On the query being raised, the corpus has refused to go along with the petitioner no. 2 Hakendra Kumar. She has expressed her willingness to live with respondent No. 4 Sri Laxmi Narayan (father). Therefore, there is no merit in the matter. Accordingly, the Habeas Corpus Writ Petition is dismissed.
