Apprehending his arrest in connection with Senha P.S. Case No.24 of 2024, corresponding to G.R. No.285 of 2024 instituted under Sections 302/34 of the IPC and Section 27 of the Arms Act, the petitioner has moved this Court for grant of privileges of anticipatory bail. Learned counsel appearing for the petitioner submits that the allegation against the petitioner is that the petitioner in furtherance of common intention with the co-accused person(s) committed the murder of Naresh Kumar Sahu @ Sibu. It has further been submitted that allegation against the petitioner is false. Sadam and Manauwar were the persons, who paid Rs.5,00,000/- to the co-accused Amresh Mishra for committing the murder. It is lastly submitted that the petitioner is ready and willing to co- operate with the investigation of the case and though there are five cases pending against the petitioner and they are old matters. Hence, it is submitted that the petitioner be given the privileges of anticipatory bail. Learned Addl. P.P appearing for the State on the other hand vehemently opposes the prayer for grant of anticipatory bail and submits that petitioner is hardened criminal. Hence, it is submitted that c in view of serious nature of allegation and the conspiracy involved, custodial interrogation of the petitioner is required during the investigation of the case to find out the other details of the case. It is lastly submitted that the petitioners ought not to be given the privileges of anticipatory bail. Considering the serious nature of allegation against the petitioner for committing murder of Naresh Kumar Sahu @ Sibu as well as the requirement of their custodial interrogation during the investigation of the case and the criminal antecedents of the petitioner, this Court is of the considered view that this is not a fit case where the above-named petitioner be given the privileges of anticipatory bail. Accordingly, the prayer for grant of privileges of anticipatory bail of the above-named petitioner is rejected. (Anil Kumar Choudhary, J.) Anjali/
