This writ petition has been filed with the following prayer:- "(a) Issue an order or direction, in the nature of Mandamus commanding/directing the respondent No.1 Sub-Divisional Magistrate, Tehsil Sadar, District Mau to decide the Suit No. 8218 of 2023, Computerized Suit No. T202315510108218, (Chandrabhan Vs. State of U.P.) under Section 38(2) of the Uttar Pradesh Revenue Code, 2006, pending before him, expeditiously or within the stipulated period as may be fixed by this Hon'ble Court." It is contended that the proceedings under Section 38 (2) of U.P. Revenue Code, 2006 are pending consideration, which are registered as Case No.8218 of 2023. The sole prayer made in the writ petition is for expeditious disposal of the said case. As no useful purpose would be served in keeping the matter pending, or calling for counter affidavit, the matter is being disposed of, at the admission stage, with a direction upon respondent no.1- Sub Divisional Magistrate, Tehsil Sadar, District- Mau to decide the Case No.8218 of 2023 filed under Section 38(2) of the U.P. Revenue Code, 2006, after hearing all the concerned parties, strictly in accordance with law expeditiously preferably within a period of two months from the date of production of certified copy of this order. With the aforesaid direction, present writ petition stands disposed of. It is made clear that this Court has not adjudicated the case on merit.
