By way of instant application following prayer has been made:- "It is, therefore most respectfully prayed that this Hon'ble Court may graciously be pleased to Stay the impugned order dated 23.05.2025 passed in Criminal Case No.18020/2017 (State Vs. Rajesh Kumar & Others) arising out of Case Crime No.295 of 2017, under Sections 409, 418, 420, 421, 463, 467, 471, 477, 201, 120-B, 468, 477A, 34 I.P.C. Police Station-Civil Lines, District-Prayagraj, pending in the Court of Chief Judicial Magistrate, Prayagraj, during the pendency of the present application before this Hon'ble Court. It is further prayed that this Hon'ble Court may graciously be pleased to release the Passport of the applicant and further, allow the applicant to travel abroad, otherwise, the applicant shall suffer irreparable loss and injury." 3. At the very outset, learned counsel for the applicant submitted that as trial of the instant case has been transferred today to the Court of C.B.I., Lucknow, therefore, instant application has become infructuous and the same may be dismissed as withdrawn with liberty to the applicant to approach before appropriate forum. 4. Learned counsel for C.B.I. is having no objection. 5. In view of the above, instant application stands dismissed as withdrawn with liberty as prayed.
