CITY CIVIL AND SESSIONS JUDGE (CCH-53), BENGALURU AND ALSO SET ASIDE THE JUDGMENT ORDER OF SENTENCE DATED 13.09.2019 PASSED IN C.C.NO.30835/2017 BY THE XX ACMM BENGALURU AND ACQUIT THE ACCUSED AND AWARDING COSTS, THROUGHOUT AND ETC.,
THIS PETITION COMING ON FOR CONCILIATION BEFORE NATIONAL LOK ADALAT, THE FOLLOWING CONCILIATION ORDER IS PASSED. CONCILIATION ORDER
This criminal revision petition is filed by the petitioner/accused praying to set aside the judgment and order dated 08.12.2021 passed in Crl.A.No.2140/2019 by the LII Additional City Civil & Sessions Judge (CCH- 53), Bengaluru and also to set aside the judgment and order of sentence dated 13.09.2019 passed in CC.No.30835/2017 by the XX Additional Chief
3 Metropolitan Magistrate, Bengaluru and consequently to acquit him from the alleged offences. 2. Sri.S.Venugopala, learned counsel for the petitioner and Sri.R.Srinivas, learned counsel for the respondent are present along with their respective parties. 3. After detailed discussion, the parties have amicably resolved the dispute before the Lok Adalat. A joint memo to that effect has been filed, which reads as under:
"The parties in the above proceedings have amicably settled the matter for a final sum of Rs.12,00,000 (Rupees Twelve Lakhs). The petitioner till date has made a deposit of Rs.6,04,000 (six lakhs four thousand) and the respondent shall be at liberty to withdraw the same.
The remaining amount of Rs.5,96,000 (Five Lakhs Ninety Six Thousand) shall be payable within six months from the date of this compromise, in two equal instalments, with three months interval (1st instalment is payable on or before the 12th day of March 2026 and the second instalment is payable on of before 12th day of June 2026). In the event of failure on part of the petitioner to abide by such condition, (either delay or default in payment) the judgement passed in CC No.30835/2017 shall stand confirmed, and the respondent shall execute the same in accordance with law."

In view of the above, the judgment and order dated 08.12.2021 passed in Crl.A.No.2140/2019 by the LII Additional City Civil & Sessions Judge (CCH-53), Bengaluru confirming the judgment and order of sentence dated 13.09.2019 passed in CC.No.30835/2017 by the XX Additional Chief Metropolitan Magistrate, Bengaluru are hereby set aside and the petitioner is acquitted from the alleged offences. Accordingly, the petition is disposed of as settled before the Lok Adalat in terms of the joint memo
