Sr. No.13 IN THE HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT SRINAGAR LPA 109/2025 in[HCP 40/2024 SHABIR AHMAD CHACHI …Petitioner(s)/appellant(s) Through: Mr. Naveed Bukhtiyar, Advocate Vs. UNION TERRITORY OF J AND K AND ANR. ...Respondent(s) Through: CORAM: HON’BLE THE CHIEF JUSTICE HON’BLE MR. JUSTICE RAJNESH OSWAL, JUDGE O R D E R 14-05-2025 This is an intra-court appeal against an order dated 24.03.2025: “No good ground is made out in preponing the date already fixed in the main matter. Accordingly, the application is dismissed. Let the main matter come up for consideration on the due date.” Learned counsel for the petitioner submits the matter involves the life and personal liberty of the detenue (Noor Mohd Chachi). He submits that HCP No. 40/2025 filed by the appellant is ripe for arguments and was even listed on eight different occasions in the past. But owing to paucity of time, the matter could not be taken up. He submits that the petition is now listed for 30.05.2025. Concededly, the learned Single Judge is in seisin of the matter. And as indicated earlier, the petition is listed for 30.05.2025. Thus, in the given circumstances, we are dissuaded to interfere in the matter. We are sanguine that the learned Single Judge would make every possible endeavor to take up and consider the matter on the date fixed. Needless to mention that the learned counsel for the appellant too is at liberty to make an appropriate prayer before the learned single Judge in this regard.
