1. Mr. M. Tufail, learned counsel, appearing for the petitioners fairly submits that the order dated 25th July, 2011 passed by this Court in OWP No. 980/2010, which is sought to be complied with in the instant contempt petition, has been complied with. He further submits that the petitioner, namely, Prem Singh, by whom, the aforesaid writ petition was preferred, has already left for heavenly abode and his wife is presently pursuing the matter. He, accordingly, submits that the land in question is required to be fenced by the petitioner and the same can be done only with the aid and assistance of the Police Authorities, as the wife of the deceased is 78 years of age.
2. Keeping in view the grievance projected by learned counsel for the petitioner to the effect that the land in question is required to be fenced with the aid and assistance of the Police Authorities, to which, Mr. Mohsin Qadiri, learned Sr. AAG, has no serious objection. However, he submits that this can be done only as and when the petitioner files representation before the competent Authority.
3. In the light of aforesaid, no fruitful purpose would be served to keep the instant petition alive. Accordingly, the proceedings in the instant petition are closed
4. Rule, if any framed, shall stand discharged.
CCP(S) No. 130/2022 In view of the order passed above in CCP(S) No. 184/2023, nothing remains further to be adjudicated upon. Accordingly, the proceedings in the instant contempt shall also stand closed.
