ORAL ORDER
1. The learned AGA accepts notice for Respondent Nos.1 to 4. 2. Shri.M.S.Devaraj, learned counsel is directed to accept notice for Respondent Nos.5 and 6. 3. Notice to Respondent No.7 is dispensed with, in view of the proposed order to be passed. 4. The petitioner is before this Court seeking for the following reliefs: a. Issue a writ of certiorari to set aside or cancel the letter No.E-3/Anganwadi/41/2017-18, dated 08.05.2017, issued by 3rd Respondent, vide Annexure-A, by allowing the above writ petition or in alternate b. Issue such other order or writ or direction as deemed fit in the circumstances of the case in the interest of justice and equity. . 5.
Petitioner is the President of School Development Committee of Beikoppalu, Government Primary

School. The petitioner contends that there are two rooms, which have been constructed for the said school, which houses 15 students each. The fourth respondent has now proposed to establish an Anganwadi building next to the school premises, which the petitioner claims would reduce the play area. It is in that background that the petitioner has approached this Court. 6. The learned AGA has filed a memo enclosing photographs indicating that the construction has already commenced. The foundation has been laid. Construction has proceeded to the plinth area. Her submission is that even after the construction of the Anganvadi Centre, there would be enough space, which would be available for the play area of the students, which appears to be true, in terms of the photographs, which have been produced. The requirement of Anganvadi Centre and the School being both important, I am of the considered opinion

that one cannot be done away with at the cost of the other. Anganvadi Centre providing free meals and other requirements of children in the village. The same being for a public purpose. The same cannot be objected to, by the petitioner on the grounds, which have been raised in the present petition. More particularly, that there is some other land, which is available, where it could be constructed. It could also be that the children coming to the Anganvadi Centre could also be students at the school and as such, it would be in the interest of all the children that both the Anganvadi Centre and the school are located next to each other. No grounds are being made out. 7. Petition stands dismissed. SD/- (SURAJ GOVINDARAJ) JUDGE
