(ORAL) The present petition has been filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 seeking quashing of FIR No.5 dated 29.01.2025 (Annexure P-1) under Section 25 of Arms Act and Section 3(5) of BNS added later on (Section 34 IPC-Act of common intention) registered at Police Station GRP Pathankot, District Government Railway Police, State of Punjab and all subsequent proceedings arising therefrom. At the very outset, the learned State counsel submits that the present petition is premature as the investigation of the FIR (supra) is still pending. In view of the above, learned counsel for the petitioner wishes to withdraw the present petition with liberty to file fresh petition in case final report under Section 193 of BNSS (earlier Section 173 of Cr.P.C.) is filed against the petitioner.
