HEMALEKHA ORAL ORDER The petitioner has approached this Court seeking for the following reliefs : “(i) Issue a writ in the nature of certiorari or any other appropriate writ or direction quashing Endorsement No.BemAPraa/UKaa-3/5009/2025- 26 dated 08.10.2025 issued by Respondent No.2, produced as ANNEXURE-M; (ii) Issue a writ in the nature of mandamus or any other appropriate writ directing Respondent No.1 to convey Site No.697 measuring 9 X 12 metres situated in Block-II, Arkavathy Layout, Bengaluru in favour of the Petitioner by a registered sale deed; (iii) Grant such other relief/s including costs of proceedings as this Hon’ble Court may deem fit in the circumstances of the case.” 2. Heard the learned counsel for the petitioner and learned counsel for the respondents. Perused the material on record. - 3 - HC-KAR NC: 2025:KHC:53075 WP No. 33251 of 2025 3. Learned counsel for the respondents-BDA has filed a memo along with the list of Alternative Site Allotment from Arkavathi Layout to Nadaprabhu Kempegowda Layout, which was resolved in a meeting headed by the Commissioner, BDA through randomization, wherein Site No.B1-SL-2233 (9x12) in Nadaprabhu Kempegowda Layout in lieu of the Site No.697, II Block, Arkavathi Layout, is sought to be allotted as an Alternative Site Allotment. 4. The said memo is taken on record. 5. Learned counsel for the petitioner submits that in light of the alternative site made available to the petitioner, the petitioner has no grievance in this writ petition. However, necessary directions may be issued to the respondents-BDA to allot the alternative site within a time-bound manner and execute necessary sale deed. 6. In light of the submission, the writ petition stands disposed of, directing the respondents-BDA to allot an - 4 - HC-KAR NC: 2025:KHC:53075 WP No. 33251 of 2025 alternative site and execute the necessary documents in favour of the petitioner in respect of Site No.B1-SL-2233 (9x12) in Nadaprabhu Kempegowda Layout, in accordance with law, within a period of eight weeks from the date of receipt of the certified copy of this order.
