Neutral Citation No. - 2025:AHC:112356 Court No. - 34 Case :- WRIT - C No. - 22002 of 2025 Petitioner :- Ashok Kumar And 13 Others Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Anil Kumar,Satish Kumar Pandey Counsel for Respondent :- Avinash Chandra Srivastava,C.S.C. Hon'ble Rohit Ranjan Agarwal,J. This writ petition is directed against the administrative order passed by Tehsildar, Bhugaon, District- Mainpuri on 12.04.2024. The petitioner, before this Court, submits that he was allotted land against which cancellation proceedings were initiated and allotment was cancelled. Revision No. 1586 of 2024 was preferred before Board of Revenue which is pending consideration and an interim order has been granted on 29.04.2024.
Learned counsel for the petitioners submits that Tehsildar is interfering in the matter despite the fact that revision is still pending before Board of Revenue and
order of status quo is operating. He further submits that by administrative order, hindrance is being caused in the possession of the petitioners. I have heard respective counsel for the parties and perused the material on record. From perusal of the order passed by Tehsildar, Bhugaon, District-Mainpuri on 12.04.2024, it appears that it is an administrative order and petitioner has approached this Court after more than one year. It further appears that after the interim order being granted by Board of Revenue, Tehsildar, Bhugaon, District- Mainpuri is interfering in the possession of the petitioner. In view of said fact, the order dated 12.04.2024 is hereby set aside. The writ petition stands partly allowed. However, the Board of Revenue is hereby directed to proceed with Revision No.1586 of 2024 and finally decide the same, strictly in accordance with law, within a period of three months, from the date of production of certified copy of this order. Registrar (Compliance) shall also intimate about this order to Board of Revenue, within 48 hours.
