JUSTICE SANJAY PARIHAR, JUDGE ORDE R 07.07.2025 Impugned in this appeal filed by the Union Territory of Jammu & Kashmir is an order dated 7th February, 2023, passed by the learned Additional Sessions Judge [“Designated Special Court under Section 22 of the NIA Act”] Baramulla, [hereinafter referred as “the trial court”] in case FIR No. 275/2023 registered under Sections 23 & 39 of the ULA(P) Act Section 7/251 of the Arms Act, whereby the trial court has granted bail to the accused-respondent herein. The order of bail was passed by the trial court on 7th February, 2023, and ever since the respondent is at large and attending the trial. It has not been brought to our notice by the appellant that, after being released on bail, the respondent has violated any of the terms and conditions of the bail or failed to appear before the trial court regularly. Otherwise also, out of the eight prosecution witness cited, the prosecution has already examined seven witnesses. The trial is, therefore, at the verge of completion. In view of the aforesaid, we are of the view that this is not the stage to interfere with the order of granting bail. The appeal is found to be without any merit and is, accordingly, dismissed.
