Heard the parties.
The petitioner has been made accused in connection with S.T. Case No. 422 of 2024 arising out of Jaridih P.S. Case No. 131 of 2024 for the offences registered under sections 191(2), 191(3), 190, 127(1), 115(2), 118(1), 117(2), 109, 121(1), 121(2), 132, 324(5), 303(2) and 352 of the Bharatiya Nyaya Sanhita, 2023 and section 8B of the National Highways Act, pending in the court of learned Additional Sessions Judge-II-FTC, Bermo at Tenughat. On 30.09.2024 at about 10.45 a.m., an Audi Car bearing registration no. WB 02AJB 8673 dashed a motorcycle bearing registration no. JH 09BF- 1910 near Tand Mohanpur at NH 23, due to which, two persons died. It is alleged that mob of 15 named and several unknown persons assaulted the occupants of the vehicle, due to which, they sustained injuries. It was submitted that though the petitioner is named in the FIR, but there is general and omnibus allegation against all the accused persons. It was further submitted that similarly situated co-accused persons have been granted bail by this Court and some of the co-accused persons have been granted Anticipatory Bail by a Co-ordinate Bench of this Court. In view of the submission made above, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-II-FTC, Bermo at Tenughat in connection with S.T. Case No. 422 of 2024 arising out of Jaridih P.S. Case No. 131 of
2024.
