Learned counsel for the applicant submits that due to inadvertence the prayer has been wrongly mentioned. Learned counsel for the applicant is permitted to correct the same during the course of hearing. Sri Shivarchan Mishra, learned counsel for the applicant and Sri Puspraj Singh, brief holder for the State are present. The present application under Section 528 of the Bharatiya Nagarik Suraksha Sanhita has been filed to quash the entire proceedings of Maintenance Case No. 558 of 2022, arising out of an application under Section 125 of Cr.P.C., as well as order dated 25.01.2024, whereby interim maintenance has been awarded against the applicant. After some arguments, learned counsel for the applicant does not want to press this application and wants liberty to file an appropriate application/ proceedings before the court of competent jurisdiction. Certified copy of the order may be returned to the learned counsel for the applicant after retaining a xerox thereof.
