(Oral) This is the first petition filed under Section 483 BNSS, 2023 for grant of regular bail in case FIR No.93 dated 10.04.2025 registered under Sections 115(2), 3(5), 324(2), 333 and 351(3) of BNS (offence under Section 117(2) added later on) at Police Station Sadar Bahadurgarh, District Jhajjar. 2. Mr. Parveen Kaushik, Advocate has put in appearance on behalf of the complainant and filed his Power of Attorney. The same is taken on record. 3. The present case was registered on the basis of complaint given to the Police by Azad Singh son of Tara Chand with the allegations that on 10.04.2025, at about 01.15 a.m., when he was sleeping in his house, few boys of the village who were sitting in two vehicles outside his house were creating nuisance. He opened the gate and saw that Sunder son of Chatar Singh and Monu son of Raghbir were sitting in their vehicles and Sonu was sitting with Sunder. He requested them not to create nuisance and thereafter, his neighbour Monu went to RENU 2025.08.07 10:35 I attest to the accuracy and integrity of this document Chandigarh CRM-M-34718 of 2025 -2- his home while Sunder started abusing him. He bolted the door of his house but after some time, Sunder and his brother Bijender came there armed with jelly and entered his house after breaking the door and they caused hurt to him. On hearing his noise, his son Sunil was attracted to the spot but they caused injuries to him as well as his wife Roshni and daughter-in-law Kamlesh. Thereafter, they went away while threatening to kill them in future and he again locked the house. However, after some time, Sunder and his brother Bijender went to the house of his brothers Ramkavar, Rajender, Randhir and Mahender while armed with jelly and tried to break open the door but they did not open the door of the house. The entire incident was captured in CCTV footage. Thereafter Sunder and his brother Bijender reached at the house of his younger brother Rohtas, who is Sarpanch of the village and damaged the door of his house and caused injuries to Rohtas, his wife Poonam and son Shivank with fist and kick blows and threatened to kill them in case the incident was reported to the Police. After registration of FIR, the matter was investigated. Medico legal reports were obtained and petitioner was arrested on 03.05.2025. The bail application moved by the petitioner was dismissed by the trial Magistrate as well as by the Court of learned Additional Sessions Judge. 4. I have heard learned counsel for the petitioner as well as learned State Counsel, who has opposed the bail. 5. The victim has suffered injuries on his teeth and nose which have been caused with fist and kick blows and no jelly has been used. All the offences are triable by Magistrate and petitioner is in custody since 03.05.2025. Considering all the aforesaid facts and circumstances of the case, but without commenting anything on the merits of the case, the petitioner is admitted to bail. He is ordered to be released on bail on his furnishing requisite bail bonds and surety bonds to the satisfaction of learned Trial Court/Duty Magistrate con- cerned. 7. Disposed of.
