The grievance of the petitioner is that despite proceedings being initiated at the hands of the Deputy - 3 - HC-KAR NC: 2025:KHC:33920 WP No. 16671 of 2025 Commissioner, Bangalore Urban District, as could be seen at Annexure-N1, to restore the name of the petitioner in the revenue records, no further orders have been passed by the Deputy Commissioner. 3. Learned counsel for the petitioner submits that proceedings were initiated against the petitioner at the hands of one Smt.Rathnamma and Smt.Pachamma under the provisions of the Karnataka Scheduled Castes and Scheduled Tribes (Prohibition of Transfer of Certain Lands) Act, 1978 (for short, 'the Act'), seeking resumption and restoration of the lands in question. However, the matter reached this Court in W.P.No.4335/2022 and this Court by order dated 08.07.2022, disposed of the writ petition, directing the Deputy Commissioner to forward his order dated 03.02.2022 and all material to the Secretary of the Revenue Department and the Secretary of the Revenue Department was directed to consider such order as a 'report' and take up the matter for cancellation of the permission already granted on 06.03.2004, after - 4 - HC-KAR NC: 2025:KHC:33920 WP No. 16671 of 2025 extending the opportunity of hearing to the petitioner and the contesting respondents. However, it is contended by the petitioner that the Secretary of the Revenue Department passed an order upholding the earlier permission granted on 06.03.2004 for sale in terms of the provisions of subsection 2 of Section 4 of the PTCL Act. Smt.Ratnamma and others once again filed a writ petition before this Court in W.P.No.10470/2023 questioning the said order passed by the Secretary, Revenue Department. However, on 13.12.2024 the petitioners therein filed a memo seeking leave of this Court to withdraw the writ petition unconditionally. Accordingly, the writ petition was dismissed as withdrawn unconditionally. Thereafter, the petitioner gave a representation at Annexure-N dated 15.01.2025 to the Deputy Commissioner, Bangalore Urban District, seeking restoration of the name of the petitioner in the revenue records. Learned counsel submits that though proceedings were initiated and taken up by the - 5 - HC-KAR NC: 2025:KHC:33920 WP No. 16671 of 2025 Deputy Commissioner, nevertheless, no orders have been passed till date. 4. Consequently, the writ petition stands disposed of with a direction to respondent No.2-Deputy Commissioner Bangalore Urban District, to proceed with the matter taken up, as found at Annexure-N1 order sheet and proceed to pass necessary orders in accordance with law as expeditiously as possible and at any rate within a period of three months from the date of receipt of a copy of this order.
