This contempt petition has been filed by the petitioner for initiating contempt proceedings against the respondents for not complying order/judgment dated 14.08.2023 passed in WP(C) No.2086/2023, wherein the respondents were directed to comply with the following directions: “6. Having regard to the controversy involved in the petition inasmuch as the submissions of the appearing counsel for the parties, the instant petition is taken up for final disposal with their consent and is disposed of with the direction to the respondents to consider of the claim of the petitioner as lodged in the instant petition as expeditiously as possible, preferably within a period of eight weeks from the date the petitioner submits a copy of this order along with copy of the petition accompanied with all annexures to the respondents. 7. It is made clear that this court did not express any opinion on the claim or otherwise of the petitioner, which the respondents are required to consider on its own merits uninfluenced by any observation made by this court.” 2 CCP(S) No. 178/2024 2. Statement of facts stands filed, wherein it is the stand of the respondents that pursuant to the meeting dated 21.07.2023, consideration order dated 26.11.2024 stands passed, wherein it was decided that the Government of Union Territory of J&K would foreclose all works executed by the J&K based agencies on an “as-is-where-is-basis” and a list of works was forwarded to the relevant authorities including the Tourism Department for immediate foreclosure and transfer of responsibilities to UT of Ladakh. In fact, the respondents have shown their inability to comply with the order in view of the creation of Union Territory of Ladakh and transfer of liabilities to the Union Territory of Ladakh. 3. In view of the above, the proceedings in the present contempt petition are closed leaving the petitioner free to avail appropriate remedy as available under law in respect of his grievances raised in WP(C) No. 2086/2023. Needless to say, that the consideration order placed on record by respondent No. 2 shall not come in the way of availing appropriate remedy as available under law.
