The case of the petitioners in brief is that in the year 1991 the 2 respondent took a decision to widen the Mada Streets on Tirumala with a view to provide better facilities to pilgrims and in that process, they acquired the lands of the petitioners and demolished the structures in their families in the year 2003. Since then, the petitioners are approaching the respondents for providing alternative shops for their livelihood on par with others. In that process, the 1®‘ petitioner approached the respondent authorities and the then Special Deputy Collector, LA, TTD, Tirupati sent a proposal to the Estate Officer, TTD, Tirupati to consider thier request for allotment of house plot and also a shop to live in the society. But, the said request was not considered. Thereafter, the Government has issued a G.O.Ms.No.856 Revenue (Endts. Ill) Department, dated 05.08.2003 requesting the Executive Officer, TTD to allot shops to the displaced families on annual license basis either at Tirupati or at Tirumala depending on the availability and administrative convenience. The petitioners have submitted representations, dated 22.08.2019 and 21.07.2022 nd requesting to allot shop and house in terms of the said G.O. But the said representations are not considered. Hence, the present Writ Petition is filed.
3. Heard Mr Srinivasulu Kurra, learned counsel for the petitioners, learned Government Pleader for Endowments appearing for Respondent No.1
3 and Mr A.Sumanth, learned Standing Counsel appearing for Respondent Nos.2 and 3. On hearing,
learned counsel for the petitioners submits that
4. though the petitioners have submitted representations, dated 22.08.2019 and nd respondent, requesting to allot shop and residence in 21.07.2022 to the 2 Tirumaia to the petitioners, but the 2 nd respondent has not considered the said representation, which is illegal, arbitrary and violative of principles of natural justice. Hence, the learned counsel for the petitioners requests to pass appropriate orders.
5. Per contra, learned Government Pleader for Endowments appearing for Respondent No.1 and Mr A.Sumanth,
learned counsel appearing for Respondent Nos.2 and 3 opposed for grant of any relief in this Writ Petition and prayed to dismiss the same.
6. Considering the
submissions of
learned counsel for the petitioners and the learned Government Pleader for Endowments as well as
learned counsel appearing for Respondent Nos.2 and 3, the Respondent Nos.2 and 3 are directed to consider and dispose of the representations dated 22.08.2019 and 21.07.2022 submitted by the petitioners within a period of three (03) months from the date of receipt of a copy of this order.
7. With the above directions, this Writ Petition is disposed of. There shall be no order as to costs.
As a sequel, miscellaneous applications pending, if any, shall also stand closed.
