This Petition coming on for hearing, upon perusing the Memorandum of Grounds of Criminal Petition and upon hearing the arguments of Sri ROLLA MADHAVI, Advocate for the Petitioner and the Public Prosecutor on behalf of the Respondent. The Court made the following: ORDER V i 1 THE HONOURABLE SRI JUSTICE K SREENIVASA REDDY CRIMINAL PETITION No.1590 of 2025 ORDER: The Criminal Petition, u/Sec.482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, is filed on behalf of the petitioner/A7 to grant anticipatory bail in connection with Crime No. 199/2022 of Macherla Town Police Station, Palnadu District. 2) A case has been registered against the petitioner and others for the offences punishable u/Sec.143,147,148,448,427,436,323,149 IPC. 3) Case of the prosecution in brief is that the informant is a resident of Macherla town and her husband is a TDP activist. On 16.12.2022, one Julakanti Brahma Reddy went to attend a political programme. At that time, there was a clash ensued in between the TDP party and YSRCP party activists. On that incident, the accused and some others formed themselves into an unlawful assembly and set ablaze the vehicle of TDP party. Later they went to Society colony and destroyed the TDP party office. Subsequently, all the accused reached the apartment of the informant armed with sticks and stones and damaged the cars and motorcycles which were parked in the parking area and also rushed to the house of the informant and damaged the furniture in his house and her neighbor. Hence the report. 4) Heard. Perused the record. X 2 5) Learned Assistant Public Prosecutor submitted that the investigation is at crucial stage and some more witnesses are to be examined and prays to dismiss the anticipatory bail application. On a perusal of the material available on record goes to show that 6) name of the petitioner has been shown in the First Information Report and the accusation against him is that he, along with others, is alleged to have trespassed into the house of the defacto complainant and damaged household articles, further, it is also alleged that that the petitioner trespassed in the TOP party office and destroyed the furniture in the office. Learned Assistant Public Prosecutor has vehemently opposed for grant of anticipatory bail since specific accusation has been made as against the petitioner herein. In view of the facts and circumstances of the case, this t^oyrt is not inclined to grant anticipatory bail to the ' petitioner. ■■ 7) “.^Accdrdihgly, the Criminal Petition is dismissed, petitioner is at liberty to surrender before the jurisdictional Magistrate However, the Court concerned and file an application for grant of regular bail. On filing of such application, the Jurisdictional Magistrate concerned is directed to dispose of the said application filed by the petitioner herein, on the same day, on merits.
