[2025:RJ-JP:12130] (2 of 2) [CW-4612/2014] is placed by the learned counsel for the petitioner upon the
judgment passed by Hon’ble Supreme Court in Valsala Kumari Devi M. vs. Director, Higher Secondary Education and others, reported in 2007 (8) SCC 533. Upon a perusal of the reply filed by the respondents, it is noted that as per Ordinance 141-C the selection Committee/Screening Evaluation Committee has to be formulated, which is in line with the provisions of Section 5 of the Rajasthan Universities Teachers and Officers (Selection for Appointment) Act,
1979. It is stated that the Statutory Committee after due evaluation has found the professional competence of the candidates to be “not suitable” for the said post, nevertheless, the petitioner has alleged no malafides qua the Selection Committee in the writ petition. Moreover, it is domain of the employer to choose appropriate candidates for the posts so advertised. Thence, upon a cumulative consideration of the foregoing
facts and circumstances of the instant matter, the material available on record, this Court does not find any error in the actions of the Selection Committee. Moreover, the present petition pertains to the year 2014 and today in the year 2025 no interference can be made. Accordingly, the present petition is dismissed. Pending applications, if any, shall stand disposed of.
