THESE PETITIONS COMING ON FOR CONCILIATION BEFORE NATIONAL LOK ADALAT, THE FOLLOWING CONCILIATION ORDER IS PASSED. CONCILIATION ORDER These criminal revision petitions are filed by the petitioner/accused praying to set aside the judgments dated 21.02.2019 passed by the V Additional District & Sessions Court, Hassan in Crl.A.Nos.157/2018, 159/2018 and 158/2018 and to set aside the judgments and orders of conviction dated 23.06.2018 passed by the Civil Judge and JMFC, Sakleshpur in C.C.Nos.725/2011, 726/2011 and 727/2011 respectively and consequential prayer to acquit him from the alleged offences. 2. Learned counsel Sri.Balaji Raghunathan appearing for the petitioner and Sri.B.N.Tejas/party-in-person/respondent submit that after detailed discussions, the parties have amicably settled the dispute and have filed a joint memo. The joint memo reads as under: 6 "The parties in the above proceedings have amicably settled the above captioned three matters for a total sum of Rs.30,00,000 (Rupees Thirty Lakhs). The petitioner hereby agrees to pay the entire agreed amount within a period of six months from the date of this compromise to the respondents and further agrees to pay Rs.10,00,000/- (Rupees Ten Lakhs only) in two months interval and the petitioner shall clear the entire agreed amount of Rs.30,00,000/-(Rupees Thirty Lakhs only) within six months. The petitioner has deposited Rs.50,000/- in each case and in all Rs.1,50,000/- before the Hon'ble Trial Court and it is agreed between both the parties that the said amount of Rs.1,50,000/- deposited before the Hon'ble Trial Court shall be withdrawn by the complainant/respondent herein and the said amount of Rs.1,50,000/- deposited before the Hon'ble Trial Court shall be given deduction from the total agreed sum of Rs.30,00,000/- (Rupees Thirty Lakhs only) [total settlement amount]. The Respondent in Crl.RP No.587/2019 Mr. B.S. Nagaraju has expired as such his legal heirs Mr. Santhosh B.N. and Mr. B.N. Thejus have come on record and thus have compromised the said matter on behalf of their deceased father. It is further submitted that the respondent Sri. Santhosh B.N. has authorized his own brother Mr. B.N. Thejus to sign on his behalf to this Joint Memo and also has permitted Mr. B.N. Thejus to negotiate on his behalf and to compromise the above captioned matters on his behalf. Hence this Joint Memo. Wherefore, it is humbly prayed that this Hon'ble Court be pleased to accept this Joint Memo as per the aforesaid terms by setting aside the judgment of conviction (impugned orders) in all the aforesaid cases and to dispose off the aforesaid matters in terms of this compromise in the interest of justice & good conscience." 3. Sri.B.N.Tejas/respondent in Crl.RP.No.588/2019 submits that his brother Sri.B.N.Santhosh, who is the respondent in Crl.RP.No.586/2019, has 7 authorized him to settle the matter with the accused. He further submits that the complainant/respondent in Crl.RP.No.587/2019 has died and legal representatives are brought on record, and that his brother is one of the legal representatives who has authorized him to settle the matter. The said submissions are placed on record. 4. In view of the aforesaid settlement, the judgments dated 21.02.2019 passed by the V Additional District & Sessions Court, Hassan in Crl.A.Nos.157/2018, 159/2018 and 158/2018 confirming the judgments and orders dated 23.06.2018 passed by the Civil Judge and JMFC, Sakleshpur in C.C.Nos.725/2011, 726/2011 and 727/2011 respectively are hereby set aside and the petitioner is acquitted from the alleged offences.
