JUSTICE SHIVASHANKAR AMARANNAVAR ORAL ORDER This petition is filed by the petitioner -accused No.7 under Section 483 of BNSS is praying to grant bail in Crime No.112/2025 of Kempegowda Nagar Police Station registered for offences punishable under Sections 20(b)(ii)A, 21A, 22(C), 23(a) of NDPS Act. 2. Heard learned counsel for the petitioner and learned High Court Government Pleader for the respondent –State. 3. Learned counsel for the petitioner would contend that the name of this petitioner is not mentioned in the FIR. The petitioner who was found standing with accused Nos.3 and 8 near his house has been secured. There is no recovery of any article from this petitioner. This petitioner might have made payment of Rs.6,900/- through his phone pay. The petitioner is taken for police - 3 - HC-KAR NC: 2025:KHC:46718 CRL.P No. 11713 of 2025 custody for 3 days and he has been interrogated. The petitioner is working in private firm and he is having parents. With these, he prays to allow the petition. 4. Per contra, learned High Court Government Pleader for the respondent -State would contend that there is a recovery of laptop from this petitioner which belongs to him. The said laptop has been used by accused No.8 to book the contraband in the name of accused No.3. While booking, address of accused No.3 has been given and phone number of accused No.8 has been mentioned. The laptop of this petitioner –accused No.7 has been used for booking. The investigation is still in progress. The FSL report is not yet received. If the petitioner is granted bail at this stage, he will hamper the investigation and tamper the prosecution witnesses. With this, she prayed to reject the petition. 5. Having heard learned counsels, this Court has produced FIR, complaint and other materials placed on record. - 4 - HC-KAR NC: 2025:KHC:46718 CRL.P No. 11713 of 2025 6. As per the case of prosecution, ACP of Narcotic Drugs Control Bureau, CCB, Bengaluru had received an email wherein few parcels received from foreign countries were suspected of having narcotic drugs in them. ACP has seized 06 parcels from International Post Office situated at Chamarajpet. The said parcels were containing narcotic drugs where the petitioner has transferred cash of RS.6,900/- to accused No.8 and in turn the accused No.8 has booked the contraband from the foreign country through the website. It is alleged that petitioner and accused No.3 have together purchased MDMA, ecstasy pills weighing 10 grams. The laptop of this petitioner has been used to book the said parcel. The said laptop has been seized at the instance of this petitioner. Who are all others involved in the offence is yet to be ascertained. If the petitioner is granted bail, there are chances of he hampering the investigation and tampering the prosecution witnesses. Considering the above aspects, at - 5 - HC-KAR NC: 2025:KHC:46718 CRL.P No. 11713 of 2025 this stage, when the investigation is in progress, the petitioner is not entitled for grant of bail. 7. In the result, the petition is dismissed. The petitioner is at liberty to move the bail application before Special Court after filing of the charge sheet.
