The petitioner has filed the instant petition under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 with a prayer to grant regular bail to him in case FIR No.34 dated 17.03.2025 registered under Sections 21 ©, 29 of NDPS Act and Sections 10, 11 and 12 of Air Craft Act, 1934, at Police Station Khalra, District Tarn Taran.

Learned counsel for the petitioner contends that as per the case of the prosecution, two co-accused, namely, Satinderjit Singh and Yuvrajeet Singh @ Rajdeep were arrested by the police, while they were carrying 506 grams of heroin in their conscious possession, without any permit or licence. The name of the petitioner appeared in the disclosure statement of the co-accused and after his arrest, no recovery was effected from him. The petitioner was arrested on 22.03.2025 and is in custody since then. CRM-M-34677-2025 -2- presented against him. By referring to the order dated 19.05.2025 (Annexure P- 5), he contends that almost similarly placed co-accused, namely, Manmohan Singh has been granted the concession of interim anticipatory bail by this Court.
3. On the other hand, learned State counsel has vehemently opposed the submissions made by learned counsel for the petitioner on the ground that serious allegations have been levelled against the present petitioner and he does not deserve the concession of bail by this Court.
4. I have heard the learned counsel for the parties and perused the record.
5. In the present case, admittedly, no recovery was effected from the petitioner and he is in custody for the last 04 months. Even similarly placed co- accused, namely, Manmohan Singh has been granted the concession of interim anticipatory bail by this Court, vide order dated 19.05.2025 (Annexure P-5).
6. Without commenting on the merits of the case, the present petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing bail bonds/surety bonds to the satisfaction of the trial Court/Duty Magistrate/Chief Judicial Magistrate, concerned.
